The following Terms and Use apply to this website which is operated by PLM Data Solutions. These terms and use detail the process for developing and/or managing Data Solutions for a client.

Ensure that you read and understand these terms and use.


The Contract:
Signing, or acknowledgement via email, of this document is a contractual agreement between the client and PLM Data Solutions. PLM Data Solutions is retained by you our customer as a contractor to meet your specifications. It is important to note that the approval to commence work and the payment of the deposit of 25% indicates that the client accepts the terms and conditions outlined herein.


Intellectual Copyright Development:
PLM Data Solutions will hold the intellectual copyright of all material developed by PLM Data Solutions for the client until payment of the final invoice. At this time full ownership will then transfer to the client.


Intellectual Copyright Content-Data:
Accuracy of all data is the responsibility of the client. All data is to be provided by the client, unless otherwise arranged and the client is responsible for licensing/copyright. All data provided by the client shall remain thier Intellectual Property and PLM Data Solutions will make no claim on it, nor will PLM Data Solutions seek remuneration by way of profit share (royalties) for our role.


Quotations:
The price quoted to the client is for the work listed on the quotation only. Should the client decide that changes are required after work has commenced, then PLM Data Solutions can accept these changes with the provision that additional charges may need to be renegotiated.


Payment Terms:
Payment for work is currently accepted by the following preferred methods:
~ direct bank transfer
~ Business/Bank cheque
~ cash
~ PayPal invoice

Payment breakdown
25% (Advanced Payment) of the total cost of the project upon acceptance of the quote.
50% of the total cost of the project upon delivery of the first draft.
Final 25% of the total cost of the project upon delivery of the completed works.

Payment of any balance will be due within 7 days of the invoice date. If the payment goes unpaid and there is no response to the notice of payment reminder, the data will be removed until final payment is made. There will be a 20% charge for each 14 day period the balance remains unpaid.

Note: If a cheque is returned by the bank as unpaid for any reason, the client will be liable for a "returned cheque" charge of $40.
The Advanced Payment is non-refundable after work has commenced.


Final Delivery:
If the development timeframe reaches 6 months from the date of commencement due to client delays, it is deemed that the work has been completed. Any areas still in work will be removed/left unchanged for the final release of the works and the final invoice will be issued. Further updates will be carried out as part of our maintenance contract or as an hourly rate, unless negotiated otherwise.


Ongoing Support:
Once the final payment has been received it is deemed that the work is complete. After sales support is available.


Rights:
By agreeing to these terms and use your statutory rights are not affected.
PLM Data Solutions reserves the right to change or modify any of these terms or use at any time.
